The short version (plain English)
- Booking: Work begins once your quote/order is approved.
- Payment: Invoices are due upon receipt unless we agree otherwise in writing.
- Changes: Scope changes may affect timelines and cost — we’ll talk first.
- Cancellations: Less than 24 hours’ notice = full session rate, unless I can re-book.
- Your materials: You’re responsible for rights, clearances, and insurance.
- Liability: Limited as outlined below (no lost profits or consequential damages).
- Law: Alberta.

Full Terms & Conditions
1. Agreement
All orders for services are accepted by Gary Mochoruk Creative, operated by Gary Mochoruk (“GMC”), upon the terms and conditions set out below. All orders for services become effective only upon approval by an authorized representative of GMC.
This order for services constitutes the entire agreement between GMC and the Customer. No changes or waiver of these terms shall be effective unless agreed to in writing by an authorized representative of GMC.
2. Prices & Taxes
Prices charged by GMC shall be those in effect at the date of acceptance of work and are subject to change without notice. Full rate card pricing applies unless otherwise agreed in writing.
The Customer agrees to pay all applicable taxes and to indemnify GMC for any taxes collected or paid.
3. Terms of Payment
All work is accepted on a C.O.D. basis unless credit has been established. Payment is due in full upon receipt of invoice unless otherwise agreed in writing.
Adjustments must be requested within fifteen (15) days of invoice date. Overdue accounts accrue interest at 1.5% per month (18% per annum). Customer agrees to pay all collection costs, including legal fees.
4. Cancellation
Sessions cancelled with less than twenty-four (24) hours’ written notice will be billed at 100% of the applicable rate unless the time is re-booked by GMC.
5. Shipping & Handling
Transportation and insurance of Customer materials are the Customer’s responsibility and risk. Shipments to the Customer are collect unless otherwise arranged.
6. Modifications
Customer agrees to pay all costs associated with changes in specifications and assumes all risk of resulting loss or damage.
7. Delivery
Delivery dates are approximate. GMC shall not be liable for delays or losses resulting therefrom. Delays do not constitute grounds for cancellation.
8. Customer Materials & Storage
Customer materials will be stored during post-production and for three (3) months at no charge. Thereafter, storage is at GMC’s discretion.
Materials may be returned upon payment of all outstanding invoices and written notice, at the Customer’s expense.
9. Customer Liability for Infringement
Customer agrees to indemnify and hold GMC harmless from all claims, damages, and expenses, including legal fees, arising from infringement of intellectual property rights.
10. Limitation of Warranty
GMC provides services “as is” and disclaims all express or implied warranties, including fitness for a particular purpose.
11. Limitation of Liability
GMC shall not be liable for lost profits or consequential damages. Liability, if any, is limited to replacement of equivalent raw materials where applicable.
12. Liens
GMC shall have a lien on all materials and finished work for any unpaid balance.
13. Right to Refuse Work
GMC reserves the right to refuse work that is unlawful, misleading, defamatory, or otherwise unacceptable.
14. Notice
Notices shall be deemed given if sent via email or other written electronic communication, three (3) days after dispatch.
15. Governing Law
These terms are governed by the laws of the Province of Alberta.
16. Assignment
Customer may not assign rights under this agreement without written consent from GMC.
